General Terms and Conditions of Use and Sale

These Terms and Conditions of Use and Sale (“Terms”) govern your access to and use of the Site, including but not limited to browsing, ordering products, and interacting with our content. By accessing the Site, you agree to be bound by these Terms. If you do not agree, you must stop using the Site immediately.


1. Definitions

  • “Customer”, “User”, “You”, “Your”: any individual accessing or using this Site.

  • “Company”, “We”, “Us”, “Our”: Owelly, a brand operated by Flune.

  • “Products”: all goods offered for sale on the Site.

  • “Parties”: refers collectively to the Customer and the Company.


2. Acceptance of Terms

2.1. By using the Site, you confirm that you are at least 18 years of age, or have parental or legal guardian consent.
2.2. We reserve the right to update these Terms at any time. Continued use of the Site constitutes your acceptance of the modified Terms.


3. Products, Pricing, and Orders

3.1. Product descriptions, prices, and availability are provided for informational purposes and may be changed without prior notice.
3.2. We reserve the right to cancel orders in the following cases:

  • suspected fraud or abuse;

  • product unavailability;

  • obvious pricing or listing errors.
    3.3. If an order is cancelled after payment, you will be refunded in full in a timely manner, in accordance with applicable consumer laws.


4. Shipping & Delivery

4.1. We currently ship to most countries in the EU, the UK, Australia, and selected international locations. Estimated delivery times are 7–10 business days, but not guaranteed.
4.2. You are responsible for ensuring your delivery details are accurate. We are not liable for delays or lost packages due to incorrect addresses.


5. Right of Withdrawal / Cooling-Off Period

5.1. In accordance with the UK Consumer Contracts Regulations, EU Directive 2011/83/EU, and comparable laws in Australia, Germany, Denmark, Austria, and Switzerland, you have the right to withdraw from your purchase within 14 days of receiving the goods, without providing a reason.
5.2. Exclusions from this right include:

  • personalised or custom-made products;

  • large volume orders confirmed with identification.
    5.3. You must inform us of your wish to withdraw in writing. Refunds will be issued within 14 days of receiving returned goods in unused and original condition.


6. Returns & Exchanges

6.1. If you receive a damaged or faulty product, notify us within 24 hours with photo proof to qualify for an exchange or refund.
6.2. Return costs are the responsibility of the customer unless the return is due to our error.
6.3. Initial shipping fees, customs duties or import taxes are non-refundable, unless required by law.


7. Intellectual Property

7.1. All content on the Site, including text, images, logos, and code, is the intellectual property of Owelly or its licensors.
7.2. You may not reproduce, distribute, or use any Site content for commercial purposes without written permission.


8. User Content

8.1. You may submit reviews or comments, provided they are respectful, lawful, and do not infringe on the rights of others.
8.2. We reserve the right to remove or moderate any content we deem offensive, defamatory, or in breach of these Terms.


9. Limitation of Liability

9.1. To the fullest extent permitted by law, Owelly shall not be liable for any indirect or consequential damages, including loss of data or income, arising from your use of the Site.
9.2. In all cases, our total liability is limited to the value of your order.


10. Governing Law & Dispute Resolution

10.1. These Terms are governed by:

  • the laws of England and Wales (for UK users);

  • the law of your country of residence (for EU/EEA users);

  • the Australian Consumer Law (for AU users);

  • the applicable national laws of Germany, Denmark, Austria, and Switzerland (for residents of those countries).
    10.2. In the event of a dispute, we encourage resolution through mediation first. If unresolved, you may take legal action before the courts of your country of residence, in line with local consumer law.
